Plain English version.

We list shows. We did not shoot most of the photos on this site and we do not pretend we did. If something here is yours and you want it credited differently or gone entirely, email us and we will fix it. No lawyers required, no forms to fill out. The formal process below exists for the people who need it.

Where shows come from.

Show listings are gathered from venue calendars, organizer announcements, band posts, and public event listings around the county. Bands and venues also submit their own directly.

Dates, times, addresses, ticket prices, and who is on the bill are facts. Facts are not owned by anyone, so we are free to list them. What we do not do is copy somebody else's write-up word for word and pass it off as ours. When a listing came from a specific place, the show page names it and links back.

Where band info comes from.

Band profiles are either submitted by the band or built from what the band has already published about itself, like a bio, a genre, and links to the places where their music lives. Every band can claim its profile and edit or delete it. If you are in the band and you want the whole listing gone, say the word.

Photos.

Poster art and show images come from the band, the venue, or the promoter running the event. Everything else is either licensed stock or a photo we took ourselves. We use these images to identify the show they belong to, we credit the source on the page where we know it, and we take them down on request.

We do not sell photos, we do not license them to anyone else, and we do not strip watermarks or credits.

That's your photo and you want it gone.

Easiest path, and the one most people should use. Email info@venturacountylocal.com with the link to the page and a line telling us which image is yours. You do not need to prove anything or write anything legal. We usually pull it the same day, and always within two business days.

If you would rather keep the photo up with a credit and a link back to you, tell us that instead. We are happy to do it.

Formal DMCA notice.

If you want to file a proper takedown notice under the Digital Millennium Copyright Act, send it to our designated agent below. To be valid under 17 U.S.C. 512(c)(3), it has to include all six of these:

• Your signature, physical or electronic, as the copyright owner or someone authorized to act for the owner.
• Which work you say is being infringed. A link to the original, or a clear description of it if there is no link.
• The exact URL on this site where the material appears, so we can actually find it.
• How to reach you: name, mailing address, phone number, and email address.
• A statement that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

A notice missing any of those is not a valid DMCA notice, though we will still read it and usually act on it anyway.

Designated agent.

Email is the fastest way to reach the agent. If you need a mailing address for a formal filing, ask and we will send it.

What happens next.

We take the material down or disable access to it, and we let whoever posted it know what happened and why. If the same person keeps posting other people's work, we close their account.

Counter-notice.

If your content came down and you think that was a mistake or a misidentification, you can send a counter-notice to the same agent. Under 17 U.S.C. 512(g)(3) it needs:

• Your signature, physical or electronic.
• Which material came down and the URL where it was before we removed it.
• A statement under penalty of perjury that you believe in good faith it was removed because of a mistake or a misidentification.
• Your name, mailing address, and phone number, plus your consent to the jurisdiction of the federal district court for the district where you live. If you are outside the United States, that means any district where we can be found. You also agree to accept service of process from whoever sent the original notice.

We forward valid counter-notices to the person who complained. If they do not file a court action within 10 to 14 business days, we can put the material back up.

The site design, the code, our writing, and photos we took are ours. You are welcome to link to any page here, quote a sentence or two with a link back, or tell people about a show you found. Scraping the site wholesale or republishing it as your own is not welcome. See the terms for the rest.
